Arash Homampour of The Homampour Law Firm and Pejman A. Ben Cohen of Carpenter & Zuckerman secured a Dangerous Condition of Public Property settlement for $23,750,000. Arash was brought in as lead trial attorney on this case originally and expertly handled by Michael Bomberger of Estey & Bomberger. The incident occurred at Fiesta Island in San Diego when an impaired driver was speeding the wrong way and struck a group of cyclists. The driver was ultimately convicted of multiple felonies and is serving her 17-year sentence. With Arash as the lead, the legal team was able to prove at trial that it did not matter who the driver was or whether they were sober or on drugs, the accident waiting to happen happened because overgrown shrubbery prevented the cyclists from seeing the driver and avoiding the collision. Also, mandatory warning signs designed to prevent this very incident were missing. The cyclist was left paralyzed from the neck down. The city of San Diego settled, as they were found by a jury in the first phase liability trial to be partially responsible for the crash, due to their negligent maintenance of a blind corner.
