Ready the expert for every defense theory
Highway safety experts should be thoroughly prepared for deposition and cross-examination on the specific engineering standards underlying their opinions, including how those standards were applied to the specific facts of the case and how the expert would respond to anticipated defense arguments regarding design immunity, weather causation, or budget prioritization. An expert who can calmly and specifically explain why the agency's own internal documentation supports the plaintiff's theory, rather than relying on generalized statements about safety best practices, is significantly more effective at trial or mediation.
