In 2008, Arash Homampour obtained a $2 million settlement for a Plaintiff in a very difficult liability car versus City trash truck case where the Plaintiff developed chronic pain.

Plaintiff, a nurse, was driving home from working the night shift when she crashed into a parked City trash truck. The city contended that the trash truck driver was outside the truck at the time of the incident and that Plaintiff simply crashed into the nonmoving truck because she had poor eye sight from uncontrolled diabetes. The investigating officer cited Plaintiff for crashing into the parked truck. Believing the client, we claimed the truck was moving and in reverse when it encroached into Plaintiff’s lane. The city also claimed that Plaintiff was not wearing a seatbelt and that all of her major injuries resulted from her not wearing the seat belt.

Through aggressive depositions and cross-examination of the defense accident reconstructionist, the City recognized that while it could defense the case it could also lose big time. Plaintiff had deteriorated significantly from the significant orthopedic injuries she suffered in the crash and had an acceleration of her diabetes that lead to partial blindness. With the settlement funds, Plaintiff was able to get the medical care she desperately needed.
